DEP Implements a Permit Decision Guarantee

On July 24, 2012, Governor Corbett issued Executive Order 2012-11 – which rescinds a 1995 Executive Order establishing the Money Back Guarantee – requiring DEP to immediately implement a Permit Decision Guarantee.  The Executive Order: assesses how best to make timely permitting decisions; provides clear expectations for applicants to improve the quality of applications; establishes performance measures for review staff; and develops, improving and encouraging electronic permitting tools.

For the last 18 months, DEP has been reviewing all existing permitting procedures and now is prepared to make several effective improvements.  Providing regulatory certainty to local governments, non-profit organizations and businesses is critical and must be the rule going forward.  DEP’s focus will be on receiving complete and adequate applications and the amount of time it should take to review them.

The draft policy will be published for a 30-day public comment period beginning in early September.  In addition, DEP will conduct two webinars to review the draft policy and answer questions.  Individuals interested in participating, particularly those directly familiar with permitting, can register by accessing one of the hyperlinks below.
